Terms of Use

1. Scope of Application

These Terms of Use apply to all orders, use of our design tool, and other services on myKeycaps.com. The platform provider is smart DSGVO GmbH, Am Fuchsberg 2b, 41468 Neuss, Germany.

2. Subject Matter of the Contract

myKeycaps.com offers users the opportunity to design and order individual keycaps using their own image files. The created designs are exclusively used for the production of personalized keycap products.

3. Copyright and Usage Rights for Uploaded Designs

The user warrants that they possess all necessary rights to the motifs and content they upload. They bear sole responsibility for possible violations of third-party rights, particularly copyright, trademark, or personal rights. The provider only receives simple usage rights to use the uploaded content for contract fulfillment and to manufacture the corresponding products.

3a. Prohibited Content

It is prohibited to upload content that violates applicable law or infringes the rights of third parties. This includes in particular:

• copyrighted or trademarked content for which the user does not possess the corresponding usage rights,
• offensive, defamatory, violence-glorifying, pornographic, or extremist content,
• content that violates personal rights, data protection rights, or other protective rights of third parties,
• content that violates legal prohibitions or official orders.

The provider reserves the right to reject or cancel the affected order in case of violations of these regulations. Any claims by third parties resulting from a violation of these provisions are entirely at the user's expense.

4. Customized Products / Right of Withdrawal

Since all products are manufactured according to individual customer specifications, there is no right of withdrawal in accordance with § 312g (2) No. 1 BGB (German Civil Code). Returns are only possible for demonstrably defective goods.

5. Prices and Payment

All prices are in euros including the applicable statutory value-added tax. Sales and payment processing are handled through our payment service provider Shopify. Any shipping costs will be displayed separately during the order process.

6. Warranty and Liability

Statutory warranty rights apply. Color deviations between the screen display and the final product are technically conditioned and do not constitute a defect. The provider's liability is limited to intent and gross negligence.

8. Changes to the Terms of Use

The provider reserves the right to change these Terms of Use as needed. The current version is always available on the website.
